- Standard fees are 20% per individual lot, plus G.S.T
- Reasonable costs may be levied against the vendor for freight, testing (e.g. metal assays, gemstone analysis,) picture framing/mounting, minor repairs, cleaning (for example; silver or jewellery), and/or Copyright fees for applicable artists.
- Black Sheep Auctions acts as agent for the vendor.
- Black Sheep Auctions shall describe the property in the auction catalogue as it sees fit and the vendor grants the right to illustrate any lot in the said catalogue as well as within any promotional material or advertisement. Black Sheep Auctions also has the permission from the vendor to seek the opinion of any outside source in regard to any consigned auction lot.
- Black Sheep Auctions will pay the seller the net proceeds from any sale less commission and any other agreed to charges, to be deducted from the hammer price, 45 days after the date of sale, provided Black Sheep Auctions has been paid in full and has not received notice relating to any dispute. The vendor acknowledges the auctioneers right to retain any buyers premium. If a reasonable doubt arises as to the authenticity of any item sold, Black Sheep Auctions will refund the purchasers full purchase price.
- A fee of 22% of the lower end of the catalogue estimate will be due, payable by the vendor in the event of the following:
(i) If any lot is withdrawn from the auction by the vendor within 30 days of the auction.
(ii) The vendor increases the agreed auction reserve above the lower end of the catalogue estimate before or after the auction. (Furthermore, in this case, Black Sheep Auctions is granted the option to withdraw the lot from auction.)
(iii) The reserve is increased as per clause 6(ii) above, the lot is auctioned, but fails to sell.
- Whilst in the care of Black Sheep Auctions your item or items are insured for damage caused by fire and/or the normal extraneous perils. Whilst all due care is taken, minor damage and breakage of glass is not covered. Vendors are advised to contact their own insurer if any additional cover is required. Black Sheep Auctions expressly, does not indemnify the vendor against any loss or claims outside the scope of this clause.
- The vendor warrants that they are able to pass full and unencumbered title to any consigned auction lot and that Black Sheep Auctions is indemnified by the vendor and will be kept indemnified against any and or all claims, including the defense of such claims, in relation to any consigned auction lot. This indemnity to Black Sheep Auctions to include, but not be limited to, claims relating to full or part ownership or any other rights or perceived rights over the said lot or lots, including any claims relating to intellectual property rights such as patents, copyrights or royalties, as well as claims in relation to authenticity.
- The vendor grants the auctioneer an exclusive authority to sell at reserve, any passed in lot for 7 business days after the auction. Furthermore, until a passed in lot has been removed from the auctioneer’s premises, the auctioneer retains the right to sell the item at its reserve price.
- Catalogue entries are statements of opinion only.
- It is incumbent upon vendors to contact Black Sheep Auctions between 5 and 10 days after the auction, to determine if any unsold items are to be re-auctioned. If they are not, the passed in lot or lots must be removed from the auctioneer’s premises within 10 days of the auction. Otherwise, a storage fee of $5.00 per lot per day is due. For large furniture items, the storage fee is $10 per lot per day. An item is deemed abandoned if not removed within 60 days of last being auctioned. It will be disposed of with no recourse to the vendor. Please note this condition also applies from date of lot or lots withdrawn.
- A vendor must inform us if their artwork is liable for the Resale Royalty Scheme. The scheme states that if the artwork was acquired after 8 June 2010, and sells for a hammer price of $1,000 or more, the artist is Australian, living or deceased less than 70 years, a 5% fee on the hammer price is applicable.
